1. Agreement to Terms
By accessing or using the services provided by On-VoIP ("Company," "we," "us," or "our") through the website on-voip.com or any associated services, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.
2. Description of Services
On-VoIP provides Voice over Internet Protocol (VoIP) telecommunications services, including but not limited to:
- Residential and business VoIP phone services
- Cloud PBX (Private Branch Exchange) features
- Phone number provisioning and management
- Number porting services (port-in and port-out)
- Enhanced 911 (E911) emergency calling services
- Voicemail, call forwarding, caller ID, and related features
3. Account Registration
You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to create an account. You agree to notify us immediately of any unauthorized use of your account.
4. Billing, Payment, and Refund Policy
All services are billed on a monthly recurring basis. Payment is due at the time of subscription and on each recurring billing date thereafter. We accept major credit and debit cards through our secure payment processor.
No Refund Policy
All plans and services purchased are non-refundable. Once a plan has been purchased and activated, no refunds will be issued regardless of the reason for cancellation, including but not limited to: service dissatisfaction, early cancellation, unused service time, or account termination. By purchasing a plan, you acknowledge and agree to this no-refund policy.
If your payment fails, your service may be suspended until payment is received. Accounts with overdue balances for more than 30 days may be terminated and phone numbers released.
5. Service Plans and Pricing
We reserve the right to modify our pricing and service plans at any time. Existing subscribers will be given at least 30 days' notice before any price increases take effect on their accounts. Additional fees may apply for services such as additional phone numbers ($1.50/month), E911 service ($1.00/month per number), and additional extensions.
6. Number Porting
We support porting of phone numbers to and from On-VoIP services, subject to carrier availability and regulatory requirements. Porting timelines vary and are dependent on the losing carrier. We do not guarantee specific porting timeframes. You are responsible for ensuring porting authorization information is accurate.
7. E911 Emergency Services
VoIP-based 911 service differs from traditional 911 service. You must register a valid physical address for E911 service. In the event of a 911 call, your registered address will be provided to emergency responders.
Important E911 Limitations
VoIP E911 may not function during power outages, internet outages, or equipment failures. It is your responsibility to maintain backup means of contacting emergency services. On-VoIP is not liable for any failure of E911 services.
8. Acceptable Use
Your use of our services must comply with our Acceptable Use Policy (AUP) at all times. Violation of the AUP may result in immediate suspension or termination of your account without refund.
9. Service Availability
While we strive for 99.99% uptime, we do not guarantee uninterrupted service. VoIP services require a stable internet connection and are subject to the quality and availability of your internet service provider. We are not liable for service interruptions caused by factors beyond our control, including but not limited to: internet outages, power failures, natural disasters, or third-party service disruptions.
10. Account Termination
You may cancel your account at any time through the customer portal or by contacting support. We reserve the right to suspend or terminate your account at any time for violation of these Terms, the AUP, non-payment, or any other reason at our sole discretion. Upon termination, your phone numbers may be released after a 30-day grace period.
11. Limitation of Liability
To the maximum extent permitted by law, On-VoIP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid for services in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless On-VoIP, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the services, your violation of these Terms, or your violation of any rights of a third party.
13. Dispute Resolution
Any disputes arising out of or related to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language shall be English. Each party shall bear its own costs of arbitration.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website. Your continued use of the services after such modifications constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. All applicable federal and state telecommunications regulations apply to our services.
