Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") outlines the rules and expectations for the use of On-VoIP's voice communications services. All customers must comply with this AUP at all times. Violation of this policy may result in immediate suspension or termination of services without refund.

2. Prohibited Activities

The following activities are strictly prohibited on the On-VoIP network:

2.1 Robocalling and Auto-Dialing

ZERO TOLERANCE POLICY

On-VoIP maintains a strict zero-tolerance policy for robocalling, auto-dialing, and any form of automated or pre-recorded calling. This includes but is not limited to:

  • Initiating or transmitting robocalls (automated voice calls with pre-recorded messages)
  • Using auto-dialers, predictive dialers, or power dialers for unsolicited calling
  • Making automated calls without prior express written consent from the called party as required by the Telephone Consumer Protection Act (TCPA)
  • Making any form of telemarketing or sales calls without proper authorization and compliance with all applicable federal, state, and local regulations
  • Using our services to conduct survey calls, political robocalls, or debt collection calls via automated systems without proper legal authorization
  • Generating high volumes of short-duration calls (traffic pumping or stimulation)

Violation of this robocalling policy will result in IMMEDIATE account termination, forfeiture of all phone numbers, and potential reporting to the FCC and law enforcement. No refund will be issued.

2.2 Caller ID Spoofing

Falsifying or manipulating caller ID information with the intent to defraud, cause harm, or wrongfully obtain anything of value is prohibited and violates the Truth in Caller ID Act. Customers may only display caller IDs for phone numbers assigned to their account.

2.3 Fraud and Illegal Activities

  • Using services for any fraudulent, deceptive, or illegal purposes
  • Phone scams, phishing, vishing, or social engineering attacks
  • Threatening, harassing, or abusive communications
  • Transmission of unlawful content over voice channels
  • Toll fraud or unauthorized use of telecommunications resources
  • Using the service to facilitate illegal gambling, drug trafficking, or any criminal activity

2.4 Network Abuse

  • Denial of service (DoS) attacks against our infrastructure or third parties
  • Attempting to gain unauthorized access to our systems or other customers' accounts
  • Excessive call volumes that degrade service quality for other customers (more than 5,000 minutes per line per month may trigger review)
  • Using the service for call center operations without a business plan
  • Reselling our services without written authorization
  • Exploiting vulnerabilities in our network, APIs, or software

2.5 Spam and Unsolicited Communications

  • Sending unsolicited bulk voice calls or voicemail messages
  • Using our services to send spam SMS messages
  • Engaging in any activity that violates the CAN-SPAM Act or TCPA

3. Compliance Requirements

All customers must comply with the following:

  • TCPA Compliance: Full compliance with the Telephone Consumer Protection Act, including obtaining proper consent before making marketing or automated calls
  • Do Not Call Registry: Compliance with the National Do Not Call Registry and state-level do-not-call lists
  • STIR/SHAKEN: All outbound calls are subject to STIR/SHAKEN caller ID verification
  • FCC Regulations: All applicable FCC rules governing VoIP and telecommunications services
  • Local Laws: All applicable local, state, and federal laws governing telecommunications and electronic communications

4. Monitoring and Enforcement

On-VoIP reserves the right to:

  • Monitor call patterns and volumes for violations of this AUP
  • Suspend service immediately upon detection of prohibited activities
  • Terminate accounts without prior notice for severe violations (including robocalling)
  • Report illegal activities to law enforcement and regulatory authorities
  • Cooperate with industry-wide efforts to combat robocalling and telecommunications fraud
  • Implement automated systems to detect and block suspicious call patterns

5. Consequences of Violation

Violations of this AUP may result in one or more of the following actions:

  • First Offense (Minor): Written warning with a 24-hour compliance deadline
  • Second Offense: Temporary suspension (up to 72 hours) with mandatory compliance review
  • Third Offense / Severe Violation: Immediate and permanent account termination with no refund
  • Robocalling / Fraud: IMMEDIATE termination, forfeiture of phone numbers, and referral to authorities. No warnings will be issued.

7. Modifications

On-VoIP reserves the right to modify this Acceptable Use Policy at any time. Changes will be posted on our website and will take effect immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified AUP.
